  5. I. NEED FOR AMENDMENT OF MAHABOOBNAGAR DISTRICT GAZETTE DATED 23rd DECEMBER 2011, AND NOTIFICATION.

    It is submitted that the Government of State of Andhra Pradesh has issued a GOMs No 119 (LAWJ HOME COURTS-C) DEPARTMENT, Dated 25-10-2011 Establishment of Court of Additional District and Sessions Judge at Wanaparthy, Mahaboobnagar District. Consequently the Government of Andhra Pradesh has also issued a GOMs No 245 FINANCE ( SMPC-I) Dated 2-11-2011, ordering sanction of Staff and expenditure to the Newly established Additional District and Sessions Court at Wanaparthy in Mahaboobnagar District. Based on the above said Government Orders Honourable District and Sessions Judge Mahaboobnagar is pleased to issue MAHABOOBNAGAR DISTRICT GAZETTE (EXTRAORDINARY) No 19/2011 Dated 23rd December 2011, assigning and conferring the Jurisdiction to receive and dispose of all Civil Cases, Appellate and Original arising from the areas covered by the Junior Civil Judges Courts of (1) WANAPARTHY (2) KOLLAPUR (3) NAGARKURNOOL AND (4) ACHAMPET. In this regard it is submitted that , by virtue of MAHABOOBNAGAR DISTRICT GAZETTE issued by the Honourable District and Sessions Judge Mahaboobnagar under the references of Government Orders, the entire appellate Jurisdiction of Senior Civil Judge Nagarkurnool is being ousted and thereby the litigants whose cases are pending before the Senior Civil Judge Court at Nagarkurnool are subjected to more burden, and that the very public policy of Justice to Door Steps is put in danger. It is also submitted that the Gazette Publication issued by District and Sessions Judge Mahaboobnagar is over ride of Settled Law as described under the CIVIL COURTS ACT U/s 17(3) WHICH READS AS UNDER:

    “Where a Court of Subordinate Judge is established in any District at a place remote from the seat of the District Court, the High Court may with the previous sanction of the Government, direct that an appeal from the Decrees or orders of Court of District Munsif within the local limits of the jurisdiction of such court of Subordinate Judge shall be preferred in the said court of Subordinate Judge.”
